Novara Law Wins Week-Long Insurance Defense Trial in Macomb County Court

Novara Law Partner Timothy Kubik and Senior Associate Jillian Peterson successfully represented a national insurance carrier in a week-long trial in Macomb County Circuit Court - the third win in a month for the firm's Insurance Defense legal team.

The case involved hundreds of thousands of dollars of claims for lost wages, household services, attendant care, and medical bills for physical therapy, a hip surgery, medications, injections, and numerous other treatments. Plaintiff alleged the claims were related to a 2019 accident in which her vehicle was rear-ended by a semi-truck, causing extensive damage.

Plaintiff rejected a $100,000 case evaluation award and elected to proceed to trial.

At trial, the Novara Law team contended that the plaintiff only sustained minor injuries and that the vast majority of the treatment rendered by her medical providers was unreasonable, unnecessary, and merely done to exploit Michigan’s no-fault system. They further argued that the claims for household services and wage loss were fraudulent and plaintiff ultimately declined to present those claims to the jury.

The jury ultimately agreed and found that the plaintiff did not require any treatment beyond a visit to the emergency room. As the prevailing party, Novara Law’s client may pursue case evaluation sanctions and taxable costs.
